Lawn clippings are collected Monday; regular trash Monday and Thursday and, recycling (the yellow lid can) on Wednesday.
The roads and sidewalks are owned and maintained by the City of Melbourne. The association has no control over their maintenance or usage.
FPL will replace street lights. Please contact them with the appropriate street light pole number.
Technically homeowners only. Renters and guests are welcome to attend and express their opinions, but are not permitted to vote or provide input unless invited by the Board of Directors.
Homeowners receive an invoice at the beginning of the fiscal year. You can auto-pay from your bank, pay-in-person by contacting the treasurer, or directly mail to Bel-Aire Palms (BAP) P.O. Box 453, Melbourne, FL 32902. Contact the board of directors at board@belairepalms.com for additional information.
If you find that the invoice appears to be incorrect, usually due to previous charges, you can contact the Board at board@belairepalms.com. The board has noticed that occasionally invoices are sent in without checks, checks are illegible, a check arrives on its own and cannot be tied back to a property, and other such irregularities. The board is always willing to assist in resolution of these issues. The Treasurer will request documentation of payment in the form of either of the following:
A copy of the cancelled check
A copy of the pertinent entry in your bank Statement.
Either of these documents can be obtained from your bank.
A copy of your document can be mailed in or sent to the email address. The treasurer will respond when the account is reconciled.
Any member can request to view the official records of the association in accordance with Florida Statutes Chapter 119, known as the Sunshine Law. Please use any of the methods on the Contact Us page to submit a request. Written requests (email, mail) are preferred, since they allow the Board to ensure the correct records are produced.
To maintain landscape beds, trees, lawns - including removal of weeds, pavers, keep sidewalks edged, keep clean white vinyl fencing.
Covenant enforcement should be viewed as a lengthy process for persons that do not voluntarily correct the issue. The association is required to follow a series of steps, to include: notices of violations that may result in costly legal work that is born up front by the association. This is an economic decision for the Board of Directors who must decide “at what cost is enforcement worth pursuing?” on an individual basis. For that reason, the Board will exhaust every possible opportunity to contact and work with the homeowner in advance of any formal proceedings.
Please address the item(s) listed on the letter immediately. If you are the owner but not a permanent resident of the property we suggest you find someone to address the items in your absence.
The HOA does not have covenants requiring animals to be leashed. The City of Melbourne Animal Control Code as stated in Section 10-1 of the City of Melbourne Code of Ordinances wholly adopts the Brevard County Animal Control Ordinance, which prohibits for an animal to be At large in Section 14-55. Where "At large means off the premises of the owner, whether on public or private property, and not under the physical control of any person by means of a leash, cord or chain of sufficient strength to control the animal, not to exceed six feet in length."
Owners should refer any complaints regarding noise, peaceful enjoyment, and other code violations to the City of Melbourne.
The HOA has no power to evict a resident or a tenant.
The association is not tasked with this duty and bears no responsibility for the information. Sellers within the association are required to notify the HOA of a pending sale and obtain an estoppel letter, which certifies that the seller is current on their payments to the HOA.
The association maintains a "pond" along the western edge of the subdivision. From Florida Avenue, heading west of the subdivision, it can be seen on the right, enclosed in a chain-link fence. The southern edge is dry and looks like a deep grassed swale. The northern portion is wider, and was designed as a wet-detention stormwater treatment system. A photo is included below:
Section 14 of the Covenants and Restrictions of the association state "Äll fencing installed by Owners on Lots shall be approved by the Association, as to design, materials and location. All fencing so installed shall be maintained in such a manner to be in constant state of good repair and appearance."
The HOA has not established a policy document providing specific criteria on fencing, therefore merely notifying the Board of Directors of your intent to install such fencing is all that is currently required. Fencing is regulated by the City of Melbourne and a City building permit is required prior to installing a fence.
