State Law Changes Ability of City to Investigate Anonymous Code Complaints
Beginning today (July 1), the City of Melbourne may no longer investigate or initiate code enforcement action from anonymous complaints, pursuant to Florida law, and except as provided below.
The same requirements apply to complaints submitted online, in-person, by phone, mail, or other means of submission.
Florida law does allow anonymous complaint for circumstances that present an imminent threat to public health, safety, or welfare, or the imminent destruction or habitat of sensitive resources.
To submit a complaint related to these circumstances, please contact the City of Melbourne Code Compliance Division at 321-608-7905.

The Annual Meeting took place on February 14, 2017 from 7:30 pm to 9:35 pm. There was a quorum! In accordance with the By-Laws elections were held to elect two directors. It was established by the new HOA attorney, Mr. Chipman, that the Bel-Aire Palms HOA's directors are elected on a staggered schedule. Every even year 3 directors are elected, and odd years two directors are elected. This being 2017, Mrs. Teer and Mr. Ramirez were up for reelection. Both were re elected. In accordance with the By-Laws, immediately following adjournment of the general meeting the directors met and reelected all officers. All officers retained their positions for the 2017 annual cycle.
The Board has been BUSY! Mr. Neil, the president; Ms. Teer, the vice president; and Ms. Diehl, the treasurer, are working on reestablishing services formerly provided by the management company. The new Board has discovered that Advanced Property Management was being paid a significant monthly fee to manage the BAP operations, and we are seeking to either handle the operations in-house by the directors, or hire a much smaller company willing to perform only those tasks which are difficult for our volunteer directors to manage. The board has been interviewing attorneys, reestablishing a contract with the accountant, creating new bank accounts, establishing a new phone number, email addresses, this website, and a P.O. Box to centralize and facilitate communications.
New Attorney
The Board has interviewed 3 attorneys and is considering each. The three attorneys did appear to be knowledgeable and capable and we hope to resolve this issue soon.
Accountant
At its January meeting the board agreed to continue services with our current accountant and is considering expanding their services to conduct annual invoice mail-outs, and other regular maintenance activities.
Insurance
The BAP is required (and it is a good idea!) to carry insurance and Ms. Diehl and Ms. Teer have been working towards verifying that we are currently bonded and insured.
Maintenance Contracts
The board is currently reviewing all maintenance contracts. Some appear to be very high, and the quality of the work, particularly around the pond, is questionable. The board will continue to work on this issue over the coming months.
Budget, Annual Dues, and Invoicing
The Board is working quickly to resolve the budget for the upcoming year, and is looking to maintain the dues from last year. Without APM's monthly fees it should be possible to meet all obligations and possibly save some monies to provide additional pond maintenance and perhaps fund a community event to bring us together.
The former Board was recalled through a majority vote of the members of the Bel-Aire Palms Homeowner Association. The new Board has repealed both the 2014 and 2016 "Upkeep Specifications". Immediately following the recall, BAP received notification that the management company, Advanced Property Management (APM), had cancelled their contract, effective immediately. In addition, BAP's attorney, Mr. John Soileau, has notified the Board of his intent to cease representation, but has provided adequate notice and has volunteered to stay on until another attorney is hired. The Board has been working towards reviewing all documentation provided by the various parties to ensure all BAP's responsibilities continue to be met.
